1. Pricing, Deposit & Confirmation The total fee for the session is $150.00. To secure your allocated time slot, clients may choose to pay the full amount upfront at the time of booking, or opt to pay a 25% non-refundable booking fee of $37.50 via bank transfer within 24 hours of selecting a slot. If neither the full payment nor the 25% booking fee is received within this 24-hour window, the slot will be automatically released to other clients. For bookings secured with a deposit, the remaining balance of $112.50 must be paid and cleared via bank transfer on or before the day of the shoot, prior to the session commencing. 2. What Your Session Includes The session fee covers a dedicated 30-minute time slot, a professional photographer, and professional camera equipment. Upon completion of the project, the booking entitles the client to five (5) selected high-resolution, edited digital images delivered with a personal display license. 3. Proofing Galleries & Additional Purchases Following the shoot, clients will be granted access to a private, online proofing gallery to select their five included images. All images within this initial proofing gallery will feature watermarks. Additional individual images, photo bundles, or the option to have watermarks removed from extra files may be purchased directly through the gallery ecosystem at an additional cost. Unwatermarked high-resolution files are only released once final selections or additional purchases are cleared. 4. Punctuality & Cancellations Because these sessions are booked sequentially in strict blocks, each session will start and end exactly at the scheduled time. Any late arrival by the client will directly deduct time from their 30-minute session. If a client needs to reschedule, a minimum of 72 hours' notice must be provided. With at least 72 hours' notice, the booking fee can be credited toward a future available date. Cancellations or rescheduling requests made with less than 72 hours' notice will result in the forfeiture of the booking fee. 5. Image Ownership & Privacy In line with standard creative and legal practices in New Zealand, Higher Frequencies Group retains full copyright to all images captured during the session. Public sharing of any images for portfolio or promotional purposes is completely voluntary. Higher Frequencies Group deeply respects your privacy and will strictly adhere to the specific portfolio consent selection made on the initial booking form. 6. Personal Use & Print Licensing The unwatermarked high-resolution digital images selected by or purchased by the client include a non-exclusive, lifelong personal-use license. This license grants the client the right to make unlimited physical prints, copies, enlargements, and photo gifts for personal use, as well as the right to display the images on personal social media profiles. The client agrees that these images are for personal enjoyment and self-promotion only and may not be resold, licensed to third parties, or used for commercial corporate business promotion without the express written consent of Higher Frequencies Group. For commercial licensing, corporate branding use, or exclusive rights inquiries, please contact us directly prior to or following your session for a custom commercial quote. 7. Liability Limitations & Disclaimers Higher Frequencies Group utilizes professional-grade equipment and redundant backup protocols; however, in the highly unlikely event of equipment failure, data corruption, severe weather, or unforeseen emergencies that prevent the session from occurring or being delivered, Higher Frequencies Group’s total liability is strictly limited to a full refund of all monies paid by the client for that specific session. Under no circumstances will Higher Frequencies Group be liable for indirect, consequential, or incidental losses. 8. Data Protection & Privacy Compliance In accordance with the New Zealand Privacy Act 2020, any personal information collected during the booking process (including names, contact details, and email addresses) will be used strictly for communication, invoicing, and gallery delivery purposes. Higher Frequencies Group will never sell, lease, or share your personal information with third parties. 9. Governing Law & Dispute Resolution These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the New Zealand courts and tribunals (such as the Disputes Tribunal). Nothing in these terms is intended to contract out of or limit your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986, except where permitted by law.
